The work of a manager in public administration from the point of view of the IT generation

The bachelor thesis is focused on working with people in public administration from the point of view of the young generation of information technologies. The theoretical part of the thesis deals mainly with the functioning of public administration and construction law. And it also mentions the basics of teamwork, communication with people and their motivation. In the empirical part I specified research questions, which are looking for answers to two main topics of my work. What does working with young people look like from the point of view of public administration workers and how young people perceive work in the public sector. As a representative of this generation, I chose graduates of the field of Municipal Engineering. The empirical part of the work is examined by using questionnaire surveys and guided interviews, based on which predetermined research questions will be answered.

Legal framework of spatial regulation at the city level Abstract This diploma thesis would describe the mechanisms of spatial regulation, which is a significant part of the construction law. The goal of this thesis is to analyze the system of spatial regulation, to describe it's position within construction law and to help the reader to navigate himself through this system. Spatial regulation is a segment of construction law meant to preserve sustainable development of territories and the balance between private interests of residents and builders and many public interests via limitation of the three-dimensional form of buildings or via implementing other related demands towards the builders. The thesis would describe tools of territorial planning and the outcoming spatial regulations and the technical terminology used in the field of spatial regulation. Based on some practical examples shown in the thesis, the reader should be able to recognize, how small and big cities use a very different approach in terms of territorial planning and spatial regulation. The thesis would describe some specifics of the capital city Prague, since this difference can be seen with the most intensity. Extension build-up area countryside.

As a bubject of my diploma work I chose the extension build-up area countryside. I chose this subject because I was able to oversee the development of new housing estate Na Křižovatkách in Boršov nad Vltavou. The aim of my work is to point out the large number of administrative tasks in connection with the initial work and throughout the new housing estate development. The first part covers the history of housing development and the origins of villages in our country, developments and changes of village buildings and the history of Czech planning law. I also cover the history of Boršov nad Vltavou. The second part is aimed at the new trends in housing in comparison with the historical trends, at the plans for futur housing developments and housing construction. The next part is the realization of the development. I also cover the development problems and liabilities for the futur in cinnection with new housing. The last part compares the positive ahd negative effects of the expansion of new housing estates in rural areas.

Public law aspects of the construction and operation of water works Abstract The subject of this thesis is to describe the administrative law relations that arise in the construction and operation of waterworks, as one of the types of construction that public construction law recognizes. The thesis focuses on the legal regulation of the construction and operation of major waterworks, such as hydroelectric power stations or dams. An important feature of this work is an attempt to bring closer the general institutes of administrative law, which the regulation of water law contains and de lege ferenda considerations in this specific area of public law. In the first part of this thesis, water law is defined as a branch of law with an overlap into private and public law and the relevant sources for the construction and operation of water works are defined, while the following chapter characterizes the relationship of Act No. 254/2001 Coll., on Water and on Amendments to Certain Acts (Water Act) with other regulations of the general part of administrative law. Special powers of the building offices Abstract This diploma thesis deals with the special powers of the building offices. These can be understood as defined legal instruments with which are building offices equipped in order to protect public priority. The main goal of the thesis is to provide complex legal analysis and evaluation of the legal regulation of special powers of the building offices. The text of the thesis outlines general conception, characteristics and principles common to all of the special powers of the building offices, but also provides more detailed analysis of particular instruments that represent them. The author primarily relies on the legal regulation of Act No. 183/2006 Coll., on town and country planning and building code (Building Act), however the comparison with its "successor", meaning Act No. 283/2021 Coll., Building Act, is not left out either. The thesis is divided into eight parts. The first part provides definitions of relevant concepts, subjects, authorities and institutes, the knowledge of which is necessary for a deeper understanding of the topic. Illegal construtions and their legal destiny

The aim of this thesis named "So called black construction and their legal fate" is to provide a complex view on issues concerning black constructions in accordance with new trends in the Czech construction law. The new trends in the Czech construction law relates especially to the concept amendment of the Building Act made by Act No. 350/2012 Coll., on amendment of Planning and Building Regulation (Building Act), as amended. The further aim of this thesis is to trace the problematic issues concerning black constructions and try to suggest the solutions of these problematic issues de lege ferenda. The principle of a protection of an ownership is being compared against the principle of a public interest in the first chapter. These principles clash against each other in the issue and disputes related to black constructions. The following second chapter is dedicated to the definition of a construction in the legal manner. In the third chapter are being presented legal titles of a construction right. The next chapter deals with the process of the discharge and dissolution of a construction right and genesis of a black construction. Administrative infractions in construction law Abstract The diploma thesis entitled "Administrative infractions in construction law" focuses on the law of administrative infractions and the specifics of the basic facts of administrative infractions in the field of construction law. The diploma thesis is divided into two parts, namely the general part and the special part. The general part of the thesis aims to introduce the basics of the law of administrative infraction - it consists of the definition of the concept of an administrative infraction and analyses of its basic attributes, the definition of the conditions of liability of individuals, legal entities, and enterprising individuals in administrative infractions and introduction of the issue of administrative penalties, their functions, principles, and basic principles and aspects of their imposition with a closer focus on the administrative penalty of the fine and the principles of determining its amount, for the fine is an administrative penalty that is imposed for administrative infractions under the Building Act. Legal standing of neighbours in the procedures under the Building Act The diploma thesis deals with the legal position of neighbours in procedures under the Act No. 183/2006 Coll., on Spatial Planning and Construction Regulation (Construction Act). Although the neighbour is one of the most affected parties in the construction process, the term 'neighbour' itself is not defined in the legal order. The aim of this work is to clarify who is considered to be a neighbour for the purposes of the Construction Act and what legal status does this person have in individual procedures under the Construction Act, including the analysis of possible procedural means to protect his/her rights and legitimate interests. The thesis also points out the legal aspects of the construction process as a comprehensive procedure characterized by a chain of separate and usually successive procedures. In these procedures, the Construction Authority must not only take into account the various public and private interests in the territory, but should also be able to assess the construction project in question not only in terms of construction law but also in terms of civil law. Construction entitlement and construction permit

This diploma thesis is focused on legal aspects of a private and public construction law from builder's perspective with a special emphasis on several current issues of Czech legislation and jurisprudence. As its name suggests this thesis is divided into two parts which corresponds to construction entitlement and construction permit. The first part of the thesis is comparison of terms land and building within different legal regulations. These two terms are highly important because they represent a normative basis for the issue. Subsequently, the most frequent private- law titles, entitling the construction of a building, together with the institutions of usucaption and the problem of unauthorized construction, which are very closely related to these titles, are analyzed. The core of this thesis is the second part, dealing with spatial planning, planning proceeding and construction permitting. These partial problems are analyzed in a timeline as they naturally follow from one viewpoint of the builder. While less emphasis is placed on spatial planning and construction permits, a deeper analysis is devoted to the planning proceeding.
